President Donald Trump’s nominee to lead the United States’ law enforcement agency has insisted he is not “anti-choice”.
But in an appearance before the Senate Intelligence Committee on Wednesday, the nominee Jay Clayton repeatedly denied that former US President Joe Biden won the 2020 elections over Trump.

Clayton, a Manhattan prosecutor, met with the committee as a way to confirm his position as director of national intelligence (DNI), a cabinet position.
But these developments coincided with Trump’s false review of the fairness of US elections. Trump has claimed, without evidence, that he won the 2020 race, and critics fear he could use the government to advance the issue.
The senators pressed Clayton about his thoughts on the 2020 race between Biden and Trump, and he admitted that Biden was “confirmed” as the winner. But he avoided saying directly that Biden had “won” the race.
In one exchange, Democrat Jon Ossoff asked Clayton, “Who won the 2020 election?”
Clayton replied: “I will not do this with you.”
Ossoff replied: “This is a job interview. Then he repeated, “Who won the 2020 election?”
Clayton confirmed that he had “already answered that question”.
In another exchange, Democratic Senator Mark Kelly explored the issue.
“Tell me why Joe Biden is guaranteed to be the winner of the 2020 election,” Kelly said.
“I’m going back to my legal position here. I don’t want to continue arguing about this, but I believe he had the majority of the votes,” Clayton said, referring to the election. Electoral College system, which determines the results of presidential races.
The number of votes in each US state determines how many Electoral College votes go to a given candidate.
“So you won the election?” Kelly asked.
“He followed our process, he had the most votes, he was declared the winner,” Clayton said.
“So who has the most votes? Kelly asked.”
“That’s your look,” Clayton said. “I will not continue to do this”.
Refusal to challenge
Even Clayton seems way less than the current Director of National Intelligence Bill Pultehis response on Wednesday represented a potential stumbling block to his confirmation.
Trump is he never agreed his loss for the 2020 elections. Final polls showed that Biden won the Electoral College, with 306 votes to Trump’s 232.
He also won the popular vote, with 81,284,666 votes to Trump’s 74,224,319.
Trump has insisted that the 2020 vote was “stolen” from him by fraud, although he has not provided any evidence to support his claims.

Former Director of National Intelligence Tulsi Gabbard was present when the Federal Bureau of Investigation (FBI) raided a polling place in Fulton County, Georgia, in January.
Trump’s Justice Department has also tried to force states to reverse their decisions, which many administration officials have opposed.
On Wednesday, top Democrats criticized Clayton for being afraid to confront Trump during the hearing.
“It seems that the people who have been elected to these positions just refuse to disagree with what the president has said,” Kelly said.
Kelly went on to say that cabinet nominees must have the integrity to put US law first, even if it means disagreeing with the president.
“You’re going to be in the room with him a lot, and sometimes you’re going to have to disagree,” Kelly said. “If you can’t disagree with him when you’re not in the room, are you going to be able to disagree with him when you’re facing him in the Oval Office or the Situation Room?”
US Senator Chuck Schumer, the chamber’s top Democrat, reiterated the point in a speech on X TV.
“If you can’t accept that Joe Biden won the 2020 election, how can you lead our nation’s mental institutions?” asked Schumer.
