The 6-3 decision against Trump’s order represents a major blow to the US president and his efforts to reform immigration policy.

After taking office on January 20, 2025, Trump signed an executive order to bar those born in the US to temporary or undocumented parents from receiving US citizenship only.

Trump called the latest decision “very bad for our country” and called on Republicans in Congress to pass birth control laws. This could be an uphill battle, with polls consistently showing support for the practice and a majority of Supreme Court opinions pointing to the need for constitutional reform.

Trump’s chances of getting a new hearing appear slim, as the Supreme Court rarely grants retrial requests. It’s been decades since the court allowed a retrial to come after a ruling in a controversial case.

Change of entry

Since taking office, Mr. Trump has focused on changing almost everything all types of migration in the US.

The court gave the president a number of victories for refugees in recent months, including allowing him to end a special legal privilege for residents of troubled countries, called Temporary Protected Status, and use a controversial measure to prevent asylum seekers from setting foot on US soil, when the government is supposed to ask them to protect them.

But the Supreme Court voted against the proposal to ban the birth of US citizens, saying that the directive violates the 14th clause of the US Constitution which grants citizenship to those born in the US who are “under its jurisdiction”.

Rights groups welcomed the court’s decision. American Civil Liberties Union (ACLU) lawyer Cecillia Wang, who argued the challenge to the Supreme Court, said the decision “reaffirms an important American promise – if you’re born here, you’re a citizen”.

A study by the Migration Policy Institute-Penn State that was released in May of last year said that about 255,000 babies a year are born in the US without citizenship according to this law, increasing the undocumented population by 2.7 million by 2045.

It warned that the law “would create self-reliant, multi-generational people – US-born people would inherit from their parents and, over time, their grandparents”.
