Home Secretary Shabana Mahmood will announce legal action on Monday to deport the leader of the Rochdale Aid group.
In the year In 2012, Shabir Ahmed, who had been in prison for 22 years, was released from prison after being accused of various child sex crimes, including rape.
There have been calls in the political sector for Ahmed, who was stripped of his British citizenship, to leave the country, allowing him to retain only Pakistani citizenship.
But a small group of Commonwealth citizens who arrived in the UK more than 50 years ago cannot be deported due to a 1971 law banning removal.
It is not yet clear how Mahmoud will change the law.
Pakistan seems unwilling to accept Ahmed, who has reportedly renounced his Pakistani citizenship.
Ahmed was one of nine men from Rochdale and Oldham found guilty of exploiting 13-year-old girls at two restaurants.
After his release from prison, Ahmed was sent to a 24-hour shelter and fitted with an electronic GPS-monitored tag.
He said he would be sent back to prison if the government breached strict license conditions while in England.
Some of the victims said they were “scared” and felt “unsafe” when they were released.
At the time of his release, the victims were told that any Commonwealth nationals who entered the UK before 1973 and stayed in the country for five years could not be deported to Pakistan due to the 55-year-old Immigration Act.
While Ahmed was stripped of his British citizenship while in prison, he is exempt from deportation.
The Home Secretary will outline the legal steps she will take to remedy this.
It is not known how long it will take to change the law, but one government source previously suggested it could take up to a year.
Conservatives believe that changing the 1971 law would take too long, so they are pushing for emergency legislation or an overhaul of the current immigration law that must pass through parliament.
A spokesman for Sir Kiir told reporters on Thursday: “We are exploring all options in this matter, including discussions with the Pakistani authorities.”
