What is happening after the United States Supreme Court he ruled against the administration of US President Donald Trump, following the practice of granting citizenship to almost all people born in the US.
The 6-3 decision on birthright citizenship represents a major rebuke to one of Trump’s biggest efforts to change the US’s long-standing immigration system.

Many argued that the right to natural-born citizenship is based on the US Constitution and long-standing practices in England, rejecting the Trump administration’s claims that it should apply to US citizens and permanent residents.

This is how the Trump administration, US lawmakers and attorneys responded to the decision.
Trump and his senior officials
Stephen Miller, Trump’s top adviser and architect of his immigration campaign, called the decision “one of the most damaging and egregious decisions” in the history of the nation’s supreme court.
“American citizenship is not a natural right,” he wrote in Article X. “It belongs to Americans alone. No provision of the Constitution can be read to require us to destroy ourselves.”
Trump, meanwhile, called the decision “very bad for our country”.
Writing on her Truth Social account, she called on Congress to enact birth control laws. The president insisted that there are ways to do this that would not involve amending the US Constitution, which would require a two-thirds majority in both houses of Congress.
However, legal experts have noted that since the judges are emphasizing the 14th Amendment in this decision, there may be a need to change the constitution or even for the case to come back.
It is extremely rare for the Supreme Court to rehear cases, which would require a new legal doctrine to be established, although a bill passed by Congress seeking to end birthright citizenship could set the stage for the issue to be brought back to the Supreme Court.
“Congress needs to start TODAY working to end this costly and unjust to our Country, Birthright Citizenship. They will have my Full and Full Support!” Trump wrote.
Separately, the US Department of Justice said it would prioritize prosecutions of what it called “national tourism schemes” following the ruling.
“Actors who want to use the process to get their children’s citizenship instantly are a threat to national security and will be prosecuted,” it said.
Freedom activists
Immigration and civil rights activists have hailed the decision as a major victory.
In a statement, the head of the American Civil Liberties Union (ACLU) called the decision “one of the most important cases of the last 100 years”.
“The president bet his legacy on trying to win this victory – even going to a private debate,” Anthony Romero said in a statement, “and he lost”.
Kica Matos, President of the National Immigration Law Center, called the decision “an important victory for our democracy and for communities that bravely opposed Trump’s abuse of power to rewrite the Constitution”.
“While this is a welcome relief, it shows how fragile our basic guarantees are,” Matos said.
“The 14th amendment is clear and definite, and this proposal should not be this close.”
Elected officials
The responses of the elected officials are also very divided in the party.
Several Republicans have vowed to continue pursuing the citizenship ban in Congress, while Senator Lindsey Graham, a close ally of Trump, has said he will make the issue one of the top priorities in the Senate Judiciary Committee.
“I will continue to push to rebuild a major attraction for tourists and immigrants to the US,” he wrote on X.
Senator Eric Schmitt presented an opinion written by Justice Brett Kavanaugh, who supported the majority decision, in which he says that the right to naturalization is not protected by the 14th Amendment of the US Constitution.
Instead, Kavanaugh said Trump’s executive order violates the Immigration and Nationality Act, saying Congress could change the law or write new repressive laws.
Schmitt wrote that Kavanaugh “may have left Congress at the door”.
“I’m writing legislation to pass it. And I’m going to continue to improve the American Constitution,” he said.
Several Democrats have vowed to continue to oppose the Trump administration’s efforts to reform US immigration laws.
“This is personal. I am a proud child of immigrants. I was born in the United States,” Senator Alex Padilla said in a statement. “I am a proud citizen of the United States with the right to pursue the American Dream.”
“However, as we celebrate this decision today, we cannot rest,” he said. “Because this is not the end of Trump’s attack on our Constitution, our democracy, and the very idea of what it means to be an American.”
