California may retain laws requiring AT&T to provide phone service to new customers in its wireline division, following a federal judge’s ruling last week.
The cost of AT&T sued California in May with the aim of eliminating the Government’s Carrier of Last Resort (COLR) regulations which require it to provide telephone service to every customer in its territory. The cost of AT&T requested a preliminary injunction which would prevent California from enforcing the COLR laws while litigation continues.
To win the preliminary injunction, AT&T had to show that it could succeed in its claim that California law is preempted by the Federal Communications Commission. U.S. District Judge Linda Lopez denied AT&T’s motion to dismiss the lawsuit Thursday, according to the docket entry. The case is in the US District Court for the Southern District of California.
