The Ministry of Health of Duale did not comply with the order to stop the construction work on the site where the US citizens who are infected with the virus are wanted, the court says.

Kenya’s High Court has found the minister of health in contempt for continuing with plans to build a quarantine facility for people infected with the virus in the United States. Ebola a virus that violates court rules.
Justice Patricia Nyaundi Mande said on Monday that Health Minister Aden Duale ordered the construction of the center in central Kenya to take place despite several orders in late May and early June to stop work.

“The court cannot allow its judgments to be void,” he said, according to Reuters.
He arranged for US citizens who have been diagnosed with the virus in the Democratic Republic of Congo and Uganda to be kept at Laikipia Air Base near the town of Nanyuki.
However, since Kenya recorded no disease, the plan began protests last month and hundreds of Kenyans against the desired location.
Civilians and health workers have expressed anger at the desire to send the virus and have criticized the Kenyan government for accepting $13.5m in aid to prepare for Ebola from the US as a cleanup agreement.
President William Ruto said he “gave good” to the site “because it was a collaboration and partnership with friends who have traveled with Kenya for 30, 40 years”.
Court ordered to build suspending it after complaints from the human rights organization Katiba Institute, which said the site was being planned in secret and without consultation.
This NGO has he asked more of the agreement, including health and environmental safety assessments, regulatory approvals and operational procedures.
Despite the ruling, Mr Duale insisted the facility would continue, telling parliament earlier this month that the government “will not stop”.
Mr Duale is due to appear in court on Tuesday for a reduced and sentencing hearing. Contempt of court carries a fine of up to 200,000 shillings ($1,500), and/or six months in prison.
The Ebola epidemic was confirmed in the DRC in May. It led to 896 confirmed cases and at least 232 deaths as of June 17, according to the World Health Organization.
Uganda – which neighbors Kenya – has reported 19 confirmed cases, including two deaths.
About 75 health workers in the DRC have been infected, and 17 recorded deaths.
Kenyan doctors and medical experts have been vocal about the proposed facility in Nanyuki, saying it could threaten the country’s already fragile health.
