Nintendo customers are not legally entitled to a tax refund, the company told a judge

Nintendo urged the court to dismiss the lawsuit seeking to refund money to customers, saying that people who bought the Switch or other products do not have a legal right to refund what Nintendo should receive from the government.

Nintendo said in a directions to stop yesterday that the plaintiffs “are asking (to) this Court to create a legal obligation from all fabrics to repeat the prices of the final trade because the law has changed.” Nintendo said the musicians “are not legally entitled to any refunds that Nintendo should receive.”

The The case was filed in April and two clients seeking to represent a class of people in the US who purchased Nintendo products from February 2025 to February 2026. California resident Gregory Hoffert and Washington resident Prashant Sharan filed the lawsuit. class action complaint in the US Supreme Court for the Western District of Washington, alleging unjust enrichment and violating the Washington Consumer Protection Act’s prohibition against unfair or deceptive practices.
