US judge overturns Trump’s IRS settlement, says self-inflicted | Donald Trump News


A judge in the United States ruled that the president of the United States and the Department of Justice misused the courts to solve the problem that led to the creation of the ‘anti-weaponization’ fund.

A US federal judge has ruled that a settlement between US President Donald Trump and his Justice Department was illegal.

The ruling by US District Judge Kathleen Williams on Monday indicated that the case is voluntary.

Mr Trump launched a $10bn lawsuit against the Internal Revenue Service (IRS) in January, accusing the agency of failing to properly prevent his tax evasion during his first term as president.

The DOJ later agreed with Trump to distribute a $1.8bn return to the fund to compensate what the authorities described as the victims of the “tools” of the government and the “law”.

The settlement also gave Trump tax protection.

In his ruling, Williams said Trump and the Justice Department were not adversarial in the case, as required in treason cases under the US Constitution.

“The nature of the case itself and the conduct of the parties and those of the legislators who filed it show that this was an attempt to use the Court to approve the agreement to provide protection to individuals and organizations affiliated with the President and put billions of dollars from the American taxpayers to solve complaints that are not described in the law,” he wrote.

“Ensuring that our courts are used for the purposes established by the Constitution is the duty of every judge and the duty that this Court must follow according to the decisions it has made,” he said.

The decision comes after the administration had already abandoned the so-called “Anti-Weaponization Fund” under pressure from Republican and Democratic lawmakers.

However, it represents a major rebuke to the administration and could be politically damaging for Attorney General Todd Blanche, who faces confirmation next week.

Williams also said that Blanche has been working on behalf of Trump and the DOJ throughout the process, pointing to her “ability to speak to the Prosecutors and the Opposition”.

The judge also referred Trump’s attorney in the case, Alejandro Brito, and the Justice Department officials who signed the ruling to federal officials to determine whether their actions violated constitutional rights.
