The NYT wants a Microsoft supercomputer
In 2023, the NYT became the first major publisher to sue OpenAI. The popular newspaper claimed that ChatGPT was taught its articles illegally, violated its rights by publishing the news verbatim, and harmed the market by replacing ChatGPT with the NYT subscription, and harmed its reputation by pretending to be the source of the NYT report. In addition, ChatGPT’s results of summarizing Wirecutter comments disqualified commission writers from clicking affiliate links, the NYT reported.
In the original complaint, the NYT discussed Microsoft’s supercomputing system as providing generic cloud computing services. The amended complaint seeks to allege that the mainframe was designed to facilitate OpenAI infringement and that it was designed for the purpose of training the AI on copyrighted works without permission. And as the NYT said, its articles were heavily burdened by the system, as both companies hoped to teach models of high-quality journalism, that the standard of writing could be confidently imitated in the output.
By creating this “sophisticated” system, Microsoft not only helped identify infringing works but also provided a way to steal licensed works without permission, the NYT reported.
“Microsoft planned to use the entire Internet – designed to show off the Times Works – to train the most talented LLM in history,” said the NYT.
And now they say they are profiting unfairly.
“Microsoft’s deployment of Times-educated LLMs in all its products has helped boost its market by a trillion dollars in the past year,” the NYT reported.

For the NYT, the output that was distributed at the time of discovery – including a a large section of ChatGPT user sections– remains the strongest evidence that OpenAI and Microsoft have developed tools that claim to have replaced the NYT in generating simple text for its content.
In some cases, users told ChatGPT that they were testing paid skirts and were able to view large articles by asking to see “the next paragraph.” Sometimes, “examples just spit out a few paragraphs” without any action.
