“Frankly, none of Musk’s politics have anything to do with what he’s going to do,” Musk argued before the lawsuit. In addition, “to suggest that music festivals or drugs have any meaning in this matter is strange, and how Musk spends his free time is irrelevant.”

However, OpenAI he protested that these topics are important and speak to Musk’s “interests and integrity.”

“Musk’s actions and opinions in these discussions are at risk,” the OpenAI group argued, while noting that Musk did not deny claims that drug use could impair his memory of what happened.

Musk has said that OpenAI only brings Trump in to mislead judges who are either Democrats or don’t like the president. But his ties to Trump are more important, OpenAI argued, because Musk allegedly used his influence as a consultant to influence the White House on OpenAI deals.

“In testifying, Musk testified that, despite being a ‘special government employee’ he “complained to White House officials” about OpenAI’s ‘Stargate’ project to benefit his AI company, xAI,” OpenAI argued. “Evidence that Musk used his position in government to benefit his company at OpenAI’s expense is consistent with Musk’s biases and motives, and thus his entire credibility.”

The judge seems to agree with OpenAI that some of that information is important. During Musk’s standoff, he agreed to discuss AI security with Trump without a jury, The Washington Post reported.

Most importantly, the judge will make the final call in both phases of the trial, with the jury’s opinion in the first phase now being held as an advisory.

Whether Musk blew up on the stand remains unclear, as the lawsuit continues. During the final day of questioning, Musk’s attorney got a chance to answer the potential harm by asking him a few more questions that the NYT said gave Musk a chance to “be comfortable and open.”

Musk could still be called to testify in the next three weeks, the NYT reported.
