The appellate opinion “must, not only state the law but explain the reasons for it, anticipate the outcome, and provide guidance to the lower courts that have requested it,” he said. “The law may be said in theory, but its simplicity may be believed to work with difficulty.”
Even so, Heymann and Boyden agree that Cox control is necessary because of its effect on the 2nd Circuit’s Gershwin a decision relied upon by lower courts in the past. As Boyden told Ars, the Supreme Court “clearly backed the existing test from a Gershwin back in 1971.”
The first test was “knowledge and material contributions,” he said. “And for a long time, it has been assumed that the main way in which Internet service providers of any kind can be held liable for violating the rights of users on their systems is if they are aware of the violation taking place and are providing the environment that allows it to happen.”
The Supreme Court’s decision is clear that coercion and remediation are “the only two concepts available to the agent’s breach,” but “the overall validity is vague,” Boyden said. He said that it is not clear what is required to show attraction or what it is made of.
“I mean, this is a new concept,” Boyden said. Some critics may try to “define the logic” of the circumstances under which continuing to serve infringing customers could be considered a new level of global infringement, he said.
A plaintiff will have to “show that the defendants took reasonable steps to make their work more responsive to the needs of the offenders,” Boyden said. It seems that selling the same services to every customer is not balanced, but “we don’t have any additional instructions about what that might involve to improve your service,” he said.
